1. Acceptance of Terms

By accessing and using the services provided by QuantumForgium d.o.o. ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and QuantumForgium regarding your use of our financial consulting services and website.

We reserve the right to change our fees with 30 days' written notice to existing clients.

All content, materials, and intellectual property related to QuantumForgium's services are owned by or licensed to QuantumForgium and are protected by copyright, trademark, and other intellectual property laws.

Your Rights

You receive a limited, non-exclusive licence to use materials provided specifically for your engagement. You may not reproduce, distribute, modify, or create derivative works without our written permission.

Client Information

You retain ownership of your personal and financial information. By using our services, you grant us the right to use this information to provide our services and improve our methodologies (in anonymised form).

6. Professional Standards and Disclaimers

No Guarantee of Results

• Market conditions, personal circumstances, and external factors may affect outcomes

7. Limitation of Liability

To the maximum extent permitted by applicable law, QuantumForgium's liability is limited as follows:

Exclusion of Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

Limitation of Total Liability

Our total liability to you for any claims arising from or related to our services shall not exceed the amount paid by you to QuantumForgium in the twelve months preceding the claim.

Exceptions

These limitations do not apply to liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be excluded under applicable law.

8. Confidentiality

We maintain strict confidentiality regarding all client information and financial data. Our confidentiality obligations include:

Exceptions to confidentiality include legal requirements, regulatory obligations, and situations where disclosure is necessary to provide our services (with appropriate safeguards).

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Croatia. However, we may seek injunctive relief in any jurisdiction to protect our intellectual property rights.

For clients located in other EU member states, this choice of law and jurisdiction is subject to applicable consumer protection laws and regulations.

10. Termination

Either party may terminate the service relationship under the following circumstances:

Termination by Client

• You may terminate services at any time with written notice
• Fees for completed work are non-refundable unless otherwise agreed
• Ongoing service agreements may have specific termination provisions

Termination by QuantumForgium

• We may terminate services for breach of these Terms
• Non-payment or repeated late payment may result in termination
• We reserve the right to refuse service in certain circumstances

Effects of Termination

• Outstanding fees become immediately due
• Confidentiality obligations continue after termination
• You must return any proprietary materials
• We will provide final reports or deliverables as agreed

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website, unless otherwise specified. Material changes will be communicated to existing clients via email or other direct communication.

Your continued use of our services after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of our services.
